The National Gambling Act 7 of 2004

The National Gambling Act 7 of 2004 is South Africa's primary gambling legislation. It establishes the National Gambling Board (NGB), defines categories of gambling, and sets out the framework for provincial licensing. It replaced the earlier National Gambling Act 33 of 1996.

Under the Act, gambling activities are divided into "limited payout machines" (LPMs), "bingo," and "casino" — regulated by provincial boards — and "interactive gambling" (online). Online sports betting is legal under provincial licence. Online casino has a complex status.

Online Casino — The Prohibition Gap

South Africa's online casino status is one of the more legally ambiguous positions in the English-speaking world. The key history:

  • 2004 Act: online gambling ("interactive gambling") is listed as a form requiring national legislative approval before it can be licensed
  • 2008 Amendment: a National Gambling Amendment Act was passed to create an online casino licensing framework. However, it was never proclaimed into law — i.e., it was passed but never brought into force by presidential proclamation
  • Current status: online casino gambling in South Africa exists in a legal grey zone. It is not explicitly legal; it is not comprehensively criminalised for individual players; and no domestic online casino licences exist

South African residents who access offshore casino sites are not facing criminal prosecution in practice, but they have no regulatory protection — no deposit protection, no ADR rights, no recourse if a site withholds winnings.

Tax on Winnings

South Africa does not currently tax recreational gambling winnings for individual players. The South African Revenue Service (SARS) does not classify casual betting winnings as gross income under the Income Tax Act. Professional gamblers whose primary or significant income derives from gambling may be assessed differently.

Operators pay a provincial-level gambling levy on gross gambling revenue — these are operator costs, not player taxes.
